Responsible party and scope
Terra Industries (Pty) Ltd is the responsible party for personal information processed through this website and the related enquiry, quotation, customer and marketing processes. Terra processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable South African law.
Where another data-protection law legitimately applies to a visitor or transaction, Terra will seek to meet the applicable requirements alongside POPIA.
Information we may process
Information may include name, contact details, company, country and city, delivery information, business identifiers where needed, quote and account requests, interaction history, part searches, machine details, uploaded documents and images, language preferences, security records, authentication data, cookie preferences and marketing consents.
Some fields are necessary to answer an enquiry, provide a quotation, create or secure an account, meet a legal obligation or process an order. If required information is not provided, Terra may be unable to provide the requested function.
Purposes and lawful grounds
Terra processes information to answer enquiries, identify parts, prepare and manage quotations and orders, administer accounts, provide support, prevent fraud and abuse, secure systems, meet legal and accounting duties, manage preferences, improve the catalogue and understand demand.
Processing is carried out on grounds permitted by POPIA, including consent where required, steps necessary to conclude or perform an agreement, compliance with legal obligations and legitimate interests recognised by law.
Operators, suppliers and sharing
Terra may share necessary information with operators and service providers supporting hosting, email, security, logistics, accounting, technical support or similar functions, and with suppliers or manufacturers where reasonably necessary to identify a part, obtain availability or pricing, manage warranty support or obtain technical assistance.
Terra does not sell personal information to advertisers. Service providers processing information for Terra should be used in a manner consistent with applicable security and confidentiality obligations.
International transfers
Where personal information is transferred outside South Africa, Terra will apply POPIA requirements, including section 72 where applicable, and use appropriate safeguards or another lawful basis permitted by law.
Analytics, cookies and direct marketing
Terra keeps aggregate page and search counts to understand demand. Detailed analytics, first-party identifiers and traffic-source data are processed only in accordance with the choices presented through Cookie Preferences.
Marketing-cookie consent is not the same as subscribing to newsletters, email or WhatsApp marketing. Direct-marketing permissions are managed separately. Terra manages electronic direct marketing in accordance with section 69 of POPIA, obtaining consent where required and providing appropriate objection or unsubscribe mechanisms.
Retention and security
Terra retains personal information only for as long as reasonably necessary for the purpose for which it was collected and for legal, tax, warranty, security, dispute and marketing-suppression requirements, after which information is deleted, destroyed or de-identified where appropriate.
Terra uses reasonable technical and organisational safeguards to protect personal information. If there are reasonable grounds to believe personal information has been accessed or acquired by an unauthorised person, Terra will comply with applicable notification duties under section 22 of POPIA.
Data-subject rights and complaints
Subject to law, a data subject may request access, request correction or deletion where applicable, object to certain processing, withdraw consent where processing relies on consent and request information about the processing of their data.
Privacy and PAIA requests may be initiated through info@terra-industries.co.za and the PAIA Manual published on the website. A data subject may also lodge a complaint with the South African Information Regulator.
Children
The website is intended for business enquiries and is not directed at children. Terra does not seek to intentionally collect children's personal information through the website's normal functions.
Updates to this policy
Terra may update this Privacy Policy to reflect legal, technical or operational changes. The update date displayed on this page identifies the currently published version.
